Terms & Conditions
Last updated July 2026. These terms govern your use of Open-ePos.
1. Agreement
By signing up for, accessing, or using Open-ePos (the “Service”), you agree to be bound by these Terms & Conditions and our Privacy Policy. If you are entering into this agreement on behalf of a business, you represent that you are authorised to bind that business.
2. The service
Open-ePos provides a cloud-based point-of-sale, inventory, accounting, tax and payroll platform delivered per organisation as a private workspace. We may update, improve, or change features from time to time to keep the Service secure and effective.
3. Accounts & provisioning
Signing up creates a request that our team reviews before provisioning your workspace. You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity that occurs under your account. Notify us promptly of any unauthorised use.
4. Fees & billing
Paid plans are billed on the cycle you select (monthly or yearly). Fees are stated exclusive of applicable taxes unless indicated otherwise. Unless required by law, fees are non-refundable. We may suspend or limit access to a workspace whose fees remain unpaid after any grace period.
5. Acceptable use
You agree not to misuse the Service, including by attempting to gain unauthorised access, disrupting its operation, uploading unlawful or infringing content, or using it to violate the rights of others or any applicable law.
6. Your data
You retain ownership of the data you enter into the Service. You grant us a limited licence to host and process that data solely to provide and support the Service, as described in our Privacy Policy. You are responsible for the lawfulness of the data you upload.
7. Availability & support
We work to keep the Service available and reliable, but it is provided on an “as is” and “as available” basis. Planned maintenance, factors outside our reasonable control, or the actions of third parties may affect availability from time to time.
8. Limitation of liability
To the maximum extent permitted by law, Open-ePos shall not be liable for indirect, incidental, or consequential losses, or for loss of profits, data, or goodwill. Our total liability arising out of or relating to the Service shall not exceed the fees you paid in the twelve months preceding the claim.
9. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these terms or non-payment. On termination, you may request an export of your data within a reasonable period, after which it may be deleted.
10. Changes to these terms
We may update these terms as the Service evolves. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.
